Acting on instruction from the Commission for Investigation of Abuse of Authority (CIAA), MoGA asked MoFSC to correct its previous decision and inform MoGA about it subsequently. [break]
"The minister-level decision asking MoFSC to cancel its previous decision will be reaching the forest ministry on Monday", said MoGA Secretary Pratap Pathak at a press conference organized at the ministry, adding, "We are also planning to issue instructions to all government agencies concerned to immediately revoke decisions to transfer government employees that were taken in violation of the Civil Service Act."
Secretary Pathak added that the ministry is preparing to formulate a clear-cut mechanism for the transfer of civil servants.
"Experience shows that the trend of transferring civil servants increases with a change of government," he said, adding, "Lack of a scientific and transparent civil service mechanism and absence of clear legal provisions are responsible for the reckless practice of transferring government staff."
Secretary Pathak admitted that recent decisions taken by various ministries and ministers were not objective. "It seems that most of the transfer decisions were taken on the basis of subjective judgment by staff concerned and were not objective," Pathak said, adding, "The problem will remain unresolved unless the existing legal provisions are revisited."
Asked why he approved the transfer of some 500 government staff, Minister for General Administration Ram Kumar Yadav said, "We approved the transfer decisions after finding that they were justified." Responding to questions, he said, "We approved the decisions not with any mala fide intention. We have not committed any corrupt act nor flouted any law while approving transfer decisions."
Minister Yadav admitted that most of the government staff who have been seeking transfers are found to be interested in transfers to lucrative offices like the local development ministry and entities under it, the land reform ministry, revenue offices, etc..
