A meeting of the committee on Friday directed the government, Office of the Prime Minister and Council of Ministers, Ministry of Law and Justice, and Ministry of Peace and Reconstruction to provide necessary legal frameworks to the transitional justice mechanisms.
"Though it has already been 11 months since the commissions were formed, the transitional justice mechanisms are unable to function fully in the absence of necessary regulations in line with the TRC and CIED Act," stated the press release issued by the House committee.
The then government had formed the TRC under the chairmanship of Surya Kiran Gurung and CIED under the leadership of Lokendra Mallik. However, in the absence of regulations in line with the act, both the commissions are yet to start their investigations.
The commissions had forwarded drafts of the regulations to the government five months ago. "We are told that the regulations are under discussion in the cabinet. We are informed that the cabinet's bill committee has been discussing on it," said Madhavi Bhatta, the spokesperson of the TRC.
Minister for Peace and Reconstruction Eknath Dhakal visited the TRC office on Friday and gave assurances to the commissioners that the regulations will be passed by next cabinet meeting.
"The government took a long time to formulate the regulations. The delay has hindered our formal functioning. Though we have been interacting with the victims and doing other preparatory works, we have yet to start receiving complaints from the victims and start inquiries," TRC commissioner Shree Krishna Subedi said.
CIED Chairman Mallik had met with Prime Minister KP Sharma Oli last week and urged him formulate the regulations at the earliest.
In the absence of relevant regulations, the conflict victims are unable to lodge complaints against the perpetrators. "We don't have any information on what the commissions are doing. The commissions are not interacting much with victims," said Suman Adhikari, whose father was slain by Maoists during the insurgency.
