It has been decided to forward the case to a third judge for final verdict as Judges Kumar Chudal and Rebanta Bahadur Kuwar issued a split verdict on Friday.[break]
According to sources at the appellate court, Judge Kuwar ordered the jailing of the accused until investigations are completed whereas Judge Chudal ordered them released against a reappearance date, saying there were not enough evidence to jail them.
"This case will be forwarded to the third judge for a final verdict," Chief Judge Gopal Prasad Parajuli told Republica. "It will be forwarded to the Supreme Court if the third judge gives yet another verdict."
With the division between judges, the verdict of the third judge has become crucial.
"They might be released or not depending on the verdict of the third judge," said Parajuli. Independent lawyers said that with the division between judges and forwarding of the case to the third judge, the group led by Parshuram (Krishna) Basnet, who is accused of masterminding the attack on Giri at the district court premises, might get a chance to influence the case.
"It will be very sad if those who are accused of attacking an inmate inside district court premises are released," said a lawyer.
