SC issues show cause notice to President

KATHMANDU, Jan. 4: The Supreme Court (SC) has issued a show cause order in the name of Office of the President and Office of the Prime Minister and Council of Ministers, in response to a writ petition filed arguing that the President has, in the name of political consensus, hurt the constitutional powers of the Prime Minister as per Article 38 (9) of the Interim Constitution of Nepal, 2063.



The order handed down on Friday by a single bench of Justice Damodar Prasad Sharma has asked the defendants to be present before the Court with a written reply within 15 days.



The writ petition was filed by on Tuesday Dilli Ram Guragain of Morang and Laxmi Subedi of Chitwan, called for dissolution of the call made by the President as per Article 38 (1) of the Interim Constitution for a consensus government.



The petitioners have also called for a mandamus order for approval of the ordinance on appointments to the constitutional bodies and to continue the present government until fresh elections was held.
