KATHMANDU, August 11: The Supreme Court has issued an interlocutory order to not remove the structures set up by the Norvic Hospital in public land.
A single bench of Justice Manoj Kumar Sharma issued the order against the directive of Kathmandu Metropolitan City (KMC) to remove the hospital structures within 24 hours. Spokesperson at the Supreme Court Bimal Poudel said the SC had issued an interlocutory order to not demolish the structures within the coming Monday.
On coming Monday, there will be a hearing on whether the hospital would be obliged to demolish the structures built without the map approval on public land. A written response including the reason why the hospital had to demolish the structure has been sought by the SC.
Mayor Balendra Shah himself had come to hand over the notice, urging Norvic Hospital to remove its structures on the public land. In the notice, he had argued that Norvic Hospital raised the structures as canteen in the public land with plot number 2,085 (area 1-8-1-1), which is against the contract with Nepal government. Moreover, it was established without map approval and building code.
The hospital had filed a writ petition at SC against KMC directive order on Tuesday.
