Lawyers Kishor Paudel and others filed a writ petition and requested an interim order to vacate the position of Speaker and Deputy Speaker even though proportional candidates have been registered for upcoming elections. As the process of election of the House of Representatives has started, the writ petition mentions that the term of Speaker Agni Prasad Sapkota and Deputy Speaker Pushpa Bhusal has expired.

After the election for the position of Speaker and Deputy Speaker of the House of Representatives has been published in the gazette and the closed list under the mixed election system has been submitted to the Election Commission by the respective parties.

“As it is seen that there is a need to explain whether the provisions of Article 91, Sub-article 6(a) of the Constitution will be attracted or not, and as there is no situation of irreparable damage to the petitioner, no interim order should be issued as requested by the petitioner,'' the order said.
