KATHMANDU, Jan 10: A complaint has been filed with the Judicial Council (JC) demanding the suspension of Kaski District Court Judge Nitij Kumar Rai, who ordered the release of Rastriya Swatantra Party (RSP) Chairman and former Home Minister Rabi Lamichhane on bail in the Suryadarshan Cooperative fraud case in Pokhara.
Yubaraj Saphal of Sindhuli filed the complaint with the JC on Friday, alleging that the defendants, including Lamichhane, were released on low bail despite clear evidence and facts supporting his involvement in the cooperative’s fund embezzlement. The complainant has demanded a thorough investigation into the role and conduct of Judge Rai.
“It appears that the judge has acknowledged that 814 checks were issued, money was taken from the cooperatives and payments were made. Despite these facts and evidence, releasing the defendants on a low bail reflects the judge’s incompetence, immaturity, fear due to public pressure and anarchic groups, or possible financial manipulation. A detailed investigation into the role and conduct of the judge is necessary,” states the complaint.

Yubaraj Saphal has further claimed that the court failed to consider past precedents, legal practices and the issue of justice for the victims in the cooperative fraud case. While alleging that Judge Rai’s questionable order has caused further harm to thousands of victims, he has also demanded an investigation by reviewing the original copies of all documents related to the case.
The JC has also been urged to suspend Judge Rai and bar him from participating in daily court activities until a final decision on the complaint is reached.
