Ansari's appointment challenged at Supreme Court

KATHMANDU, March 25: A writ petition was filed at the Supreme Court on Sunday challenging the recent appointment of Samim Miya Ansari as the chairman of the Muslim Commission 


Abdul Salam, hailing from Kapilvastu lodged the petition naming the Office of the President, the Office of the Prime Minister and Council of Ministers, the Office of the Constitutional Council Secretariat, the Federal Parliamentary Secretariat, the Parliamentary Hearing Committee and Ansari as defendants in the petition.

Stating that his appointment has violated the constitution and the norms of parliamentary hearings, the petitioner sought an apex court order to revoke his appointment.  The petitioner, in the petition, accused the defendants of not properly answering the questions raised on his citizenship certificate and academic certificates.


Questions were also raised even by the members of the parliamentary committee stating that there was no signature of the citizenship certificate issuing official making his citizenship certificate suspicious. 


Claiming that Ansari was a central committee member of the Communist Party of Nepal (CPN) and was listed for proportional representation at the time of his appointment, the petitioner also raised questions on his appointment to a constitutional position because political cadres are not eligible for such positions. However, Ansari was appointed to the post against the serious objection from the lawmakers and the petitioner thinks this is subject a judicial review. 


The petitioner has sought an immediate interim order barring Ansari from carrying out the duties of the chairman of the constitutional body "because it would be an irreparable loss for the nation and the people when an unqualified person holds such a prestigious constitutional position."
