Koshi Ruling coalition warns CM Karki of action for his alleged violation of provincial assembly’s special authority

KATHMANDU, May 2: The ruling coalition has warned that the Chief Minister of Koshi Province, Kedar Karki, may face action for violating the special authority of the provincial assembly.

Rewati Raman Bhandari, the chief whip of the CPN-UML, said that giving opinions on and speaking against the resolutions passed by the provincial assembly is contrary to Article 187 (2) of the Constitution.

On April 19, the provincial assembly passed a resolution directing CM Karki to seek a vote of confidence by May 7 or resign. The resolution also mentioned that if the chief minister does not comply, the province chief would be asked to begin the process of forming a new government.

However, CM Karki decided not to seek a vote of confidence, citing  to Article 168 (5) of the Constitution.

After the provincial assembly sent a letter for the implementation of the resolution, CM Karki consulted the chief attorney of the province. The chief attorney not only advised against taking a vote of confidence but also stated that the resolution was unconstitutional. Based on this opinion, CM Karki wrote to the province chief, requesting  not to proceed with the process of forming a new government as it would be against the constitution.

Despite this, UML Chief Whip Bhandari claimed that opposing or speaking against the resolution is a violation of the provincial assembly’s special authority.
