Kanchanpur DAO issued the citizenship certificates by descent to Himanshu Lakhera and Tarun Lekhera of Bhimdutta Municipality-4. [break]
While Himanshu got citizenship certificate on January 29, Tarun got it only on Friday. Many other people have started flocking to the DAO after learning that the Lakhera brothers got citizenship certificate in line with the Home Minister´s circular.
The then government formed after the success of Janaandolan II in April, 2006 had made a provision in the Interim Constitution and other related laws to provide citizenship certificates by birth to those born till the end of mid-April 1990 and residing in Nepal since then.
As per the provision in the Interim Constitution, the government had issued Citizenship Certificate Regulations on November 26, 2006, making the provision effective only for two years.
"Altogether 44 applications filed during that time are still pending," said Kanchanpur CDO Basu Dev Dahal. "We have to take a decision on those applications." CDO Dahal said his administration is obliged to follow the circular issued by the Home Ministry. "The direction of Home Ministry is like a law," he said.
CDO Dahal, however, said it was difficult to simultaneously follow the Home Ministry´s circular and abide by the provision made in the Citizenship Act 2063 BS. "There is an Act already and now we have received a new circular from Home Ministry. How can we abide by both simultaneously?" he asked.
He said that he has already written to District Development Committee and municipalities about the Home Ministry´s circular.
