Writ petition filed against SC Registrar’s refusal to treat aviation safety as a public concern

KATHMANDU, Aug 27: A writ petition has been filed due to the Supreme Court Registrar’s refusal to recognize aviation safety as a matter of public concern.

Advocate Anupam Bhattarai filed the petition seeking amendments to the law that would allow individuals without specific qualifications to hold the position of Director General of the Civil Aviation Authority of Nepal (CAAN). A bench has been established to review this petition. In addition, another writ petition challenging this decision has been filed, and a hearing date has been set.

Advocate Bhattarai is requesting the annulment of a decision made on August 5, 2024. He argues that the decision by the Director General contradicts the existing laws, international rules and regulations. He has also requested that the decision, which he believes is intended to downplay aviation accidents, not be implemented at this time.

Bhattarai asked the court to summon experts in aviation safety as amici curiae to provide insights into the critical nature of aviation safety and to issue appropriate orders. This request was rejected by the Supreme Court Registrar, and a bench was set up instead. Another petition related to this issue has also been filed, with a hearing scheduled for today.
