Rawal has also termed the writ petition ´fictitious, subjective and intended at gaining publicity´ stating that the petitioner has filed the petition by making misleading interpretation of the press statement issued by the apex court last month.[break]
Issuing a press statement on February 25, the SC had said the chief justice has a positive view regarding the proposal to head a government in order to end the ongoing political and constitutional crisis, and not out of any personal ambition.
The SC assistant spokesperson has claimed that the press statement issued by the apex court is not against the Interim Constitution and other existing laws and the press statement has also not affected any constitutional and legal rights of the writ petitioner.
A single bench of Justice Girish Chandra Lal on Tuesday had sought written clarification from the president´s office, Prime Minister Baburam Bhattarai and his office, Judicial Council, the office of UCPN (Maoist) and assistant spokesperson of the apex court, among others, regarding the proposal on formation of an election government under leadership of the CJ by March 13.
Bhattarai and his office and the office of UCPN (Maoist), among others have yet to furnish their clarifications.
Aryal on February 26 had filed the writ petition seeking the apex court intervention against the formation of a CJ-led government.
