The division bench of Judges Til Prasad Shrestha and Lekhanath Ghimire issued the order on Sunday stating that if the NMC's decision on Sharma is executed now, the court's verdict, if it cancels the decision, would have no significance as the petitioner would have already suffered from the decision.The council on August 9 had decided to suspend Dr Sharma charging her of carrying out sex-selective abortions. It is reported that the ethical committee of the council had made the decision after investigating on a three-year old complaint.
Dr Sharma on Friday had filed a petition at the appeals court claiming that NMC's decision to suspend her was full of prejudices. She has named Nepal Medical Council and Registrar Nilmani Upadhyaya as defendants.
Dr Sharma was dragged into controversy after a person came to her clinic with a spy-camera and asked her to conduct sex-selective abortion.
Sharma's lawyers claimed that the gynecologist has returned to her duty from Sunday following the court order.
