Nawajagaran Women and Child Care Center, an organization working for child rights, filed a case demanding that Nirmal Sah, a four-year-old child, whose parents were sentenced to 20 years in prison in a murder case, should not be denied the love and care of his parents at his tender age. [break]
Nirmal was left alone after his father Bharat Sah and mother Khima were convicted of murder two years ago.
Nawaraj Lamichhane of the Nawajagaran filed the writ on behalf of Nirmal demanding that his juvenile rights to receive love and care of his parents be restored. “Children up to 16 years of age should not be barred from the parental love and care,” said Lamichhane.
“We have started legal battle to ensure the rights of the boy. This writ would also help address the problems faced by dozens of other children who share Nirmal´s fate,” Lamichhane added.
Nirmal was only about three years old when his parents started serving time in prison. Now he has turned four. He is mostly found wandering around the jail where his parents are kept. His parents touch him from behind the bar. Though Nirmal has been living with his maternal grandmother, he makes frequent visits to the jail to see his parents.
According to a lawyer, Ram Saran Chaudhari, as per the legal provisions, the state itself should provide guardianship to the children like Nirmal. Pyuthan chief district officer, chief of district police officer and district prison have been made defendants in the writ.
