A single bench of SC Justice Rana Bahadur Bam, on August 20, had ordered the authorities concerned to put Karki´s appointment in status quo, pointing out that the minister´s decision to revoke his appointment was not appropriate.
But a division bench of SC Justices Top Bahadur Magar and Mohan Prakash Sitaula decided not to give continuing to the previous interim order of the apex court, thereby paving the way for Energy Minister Mahat to move forward as per his decision.
Karki had himself had filed a writ petition at the SC on Thursday, saying that the minister´s decision to revoke his appointment was unlawful. "The minister´s decision has sent out the wrong message that potential hydroelectric projects like Upper Tamakoshi cannot be undertaken through domestic investment," Karki had said in his petition.
