A cabinet meeting held on January 25 had appointed former Justice of the SC Awadhesh Kumar Yadav as the chairman of PCN for four-year tenure.
Advocates Humagain and Khatri on Wednesday moved to the SC urging the apex court to annul the government´s decision.
The petitioners have argued that the government´s decision to appoint Yadav is contravention of Article 106 (1) of the Interim Constitution.
Article 106 (1) of the Interim Constitution states that no chief justice or judge of the Supreme Court shall be engaged in or deputed to any assignment other than that of judge.
