Advocates Madhav Kumar Basnet and Meena Khadka Basnet filed the writ petition at the apex court on Sunday, claiming that the Judicial Council had appointed political cadres as judges in the past.
The petitioners have argued that the JC had appointed even a person who was the candidate of a political party in the Constituent Assembly election as judge. They have also argued that the activities of some judges attending party headquarters after their appointments had proved that the JC had appointed political cadres as judges.
Arguing that constitutional provisions also barred appointing political cadres as judges, the petitioners have asked the SC to issue an interim order over the issue.
Likewise, the petitioners have demanded a mandamus order to appoint a judge immediately after a position falls vacant rather than appointing judges in a group.
The writ petition has asked for a mandamus order to make public the basis and reasons behind any appointment of judges and justices. The petitioners have argued that the Judicial Council Act has a provision on making such information public.
The petitioners have named the Judicial Council and the Judicial Council Secretariat as defendants.
