Legal experts differ over CA polls procedure

KATHMANDU, July 19: Legal experts have expressed differing opinions on the procedure to be adopted for holding fresh Constituent Assembly (CA) election.



Speaking at a meeting called by the Election Commission (EC) on Thursday, they expressed differing opinions over amendment to the interim constitution for CA polls. [break]



Senior advocate and former Chairman of Nepal Bar Association Bishwakanta Mainali said the president can remove the legal and constitutional difficulties in order to conduct the CA polls. He also argued that the interim constitution can be amended through political consensus.



"The EC should invite all the political parties to remove legal and constitutional obstacles in order to hold the CA polls," Mainali said at the meeting.

 

Advocate Surendra Mahato, however, argued that there was no need for constitutional amendment for holding the CA polls. "The interim constitution does not need amendment as it does not bar the government from holding CA election," said Mahato, adding, "According to the verdict of the Supreme Court, the CA polls should be conducted without any amendment to the interim constitution."



EC had given July 22 deadline for the government to remove legal and constitutional difficulties for holding CA polls on November 22.
