The expansion to four lanes had almost been completed toward the north of Ghantaghar, but the task on the south was halted after owner of Hotel Crown Plaza Mahesh Ram Chaursiya moved the court. [break]
The expansion on the south had reached around 150 meters from the Ghantaghar, demolishing the structures erected encroaching the road that included Nepal Telecom´s building.
“The bench of justices Ananda Mohan Bhattarai and Purushottam Bhandari quashed the writ,” legal advisor of the sub-metropolis Rajeshwar Tiwari said. “We hope the court will also deliver favorable verdicts on 17 cases lodged by the sub-metropolis to vacate the five bighas of land encroached at Mairam Pokhari in Birgunj-5,” Tiwari added.
While moving the court, the hotel owner maintained that he had all the evidences to support his claim, including the map approved by the sub metropolis, but he had also vacated the rooms built encroaching the road anticipating an unfavorable verdict.
Ten rooms on the front side of his five-story hotel will be demolished following the verdict. The sub-metropolis has already graveled around two kilometer section of the road from Ghantaghar to Power House Chowk and will soon start black-topping the section.
The sub-metropolis had also faced problems while trying to relocate the tanga (horse-pulled cart) station from Ghantaghar at the start of the campaign five years ago. There were pressures from many quarters to leave untouched many structures adjacent to the road even before Crown Plaza moved the court five months ago.
