Hearing on army generals row put off again

KATHMANDU, March 30: The Supreme Court on Monday put off the initial hearing on the government plea against the March 24 order staying the retirement of the eight brigadier generals of Nepal Army after one of the assigned judges happened to be the friend of a lawyer involved in the case. [break]



Chief Justice Kedar Prasad Giri had assigned Justices Anup Raj Sharma and Prakash Chandra Wosti to conduct the hearing on the application that was put off even on Sunday. But Justice Wosti, before the start of the hearing, declared that he and lawyer Bal Krishna Neupane run a joint law firm when he was a lawyer. Neupane is one of the lawyers of the eight brigadier generals whose retirement has been the issue of a political controversy.



Judges code of conduct says that they shouldn´t hear the case of their families and close friends in view of fairness and impartiality.
