Hearing on IGP row adjourned yet again

KATHMANDU, May 19: The Supreme Court on Thursday adjourned the hearing on a writ petition filed by Nepal Police DIG Nawaraj Silwal seeking his appointment as Nepal Police chief. The petition was listed for hearing on Thursday.

KATHMANDU, May 19: The Supreme Court on Thursday adjourned the hearing on a writ petition filed by Nepal Police DIG Nawaraj Silwal seeking his appointment as Nepal Police chief. The petition was listed for hearing on Thursday. 



Chief Justice Sushila Karki had assigned a full bench for the trial. The full bench consisted of justices Devendra Gopal Shrestha, Cholendra Shumsher Rana, Jagdish Sharma Poudel, Deepak Kumar Karki, Kedar Prasad Chalise, Sapana Pradhan Malla and Tej Bahdur KC.



Informed sources said that the hearing was put off after it was revealed that 'Justice Shrestha was a relative of the plaintiff Silwal'. 



DIG Silwal had moved the apex court on April 13, a day after the government promoted DIG Prakash Aryal to the post of IGP of Nepal Police. In his writ petition, Silwal has alleged the government of foul play in the selection of the police chief. Plaintiff Silwal has made the Prime Minister and the Office of the Prime Minister as the defendants in the case.



DIG Silwal was one of the three contenders for the top position of the security agency. He had argued that he was the rightful heir to the top post based on the principle of seniority and performance. In documents submitted alongside the writ petition, DIG Silwal had claimed that he had earned 2 points more in four years' internal appraisal than the new IGP Aryal.



But a test conducted by the Central Police Forensic Science Laboratory at the behest of the government found that DIG Silwal had allegedly doctored the document and given him two points more than new IGP Aryal in the Nepal Police performance appraisal report of fiscal year 2072-73 BS [2015-16].
