The writ was filed by advocates Sudip Bhandari, Rohit Ojha, Saroj Kattel, along with law students Ayush Badal, Prabin Paudel and Smriti Adhikari, who argue that the agreement violates the constitutional provision.
According to the petition, an interim government, which has not received an electoral mandate from the people, lacks the authority to enter into political and structural agreements with long-term and far-reaching consequences.
It also argues that decisions taken by the executive under street pressure and in the name of protests, beyond constitutional limits, risk pushing the country toward instability and disorder.
The agreement also includes provisions such as limiting federal and provincial chief executives to a maximum of two terms in office. Petitioners have also challenged these decisions in court, claiming they directly contradict the spirit, intent, and explicit provisions of Nepal’s Constitution and existing laws governing political parties.
