With new law into force, number of cases seeking divorce from wives goes up

DAILEKH, Aug 21: With the Muluki Ain (Civil Code) 2017 coming into force on August 17, a number of cases for divorce filed by males have suddenly gone up.

As of August 20,  three cases were filed at the District Court by males seeking divorce from their wives. The divorce cases have been registered in line with the provision laid down in the Civil Code 2017 that allows males to file cases for divorce from their spouses.

The Muluki Ain (Civil Code) 2017 came into force on August 17 which has allowed the husbands in Nepal to file divorce cases against their spouses.

Similarly, a woman has filed a case against her husband for domestic violence.

Indra Bahadur Rana, 26, of Mahabu rural municipality -2, is the first man to file a case in the rural municipality against his wife for divorce following the enforcement of the Civil Code, said Binod Acharya, spokesperson at the District Court, Dailekh.

Similarly, Sudip Kumar Adhikari of Narayan municipality-2 has also filed a case at the court seeking divorce from his wife.

Nabin Kumar KC of Narayan municipality-8 has also filed a case for divorce from his wife, said Acharya.

Likewise, Laxmi Bhandari of Mahabu rural municipality-3 has registered a case at the court against his husband for domestic violence.

In the petitions filed by males, it has been mentioned that their wives were staying at their maternal homes or in rented rooms and did not want to return home.

According to Acharya, the cases have been field invoking the Clause 94 of Muluki Ain (Civil Code) 2017.

Of the total 210 cases field at the court, as many as 80 cases have been field by women for divorce in the district. This shows an ever-widening rift in the relationship among spouses in the society.

Earlier, males willing to divorce from his wives had to file a case at the local unit. The case would be forwarded to the District Court if deemed reasonable only after a year while females seeking divorce could directly register the case at the court.
