SC stays implementation of Proportional Advertising Directive

KATHMANDU, March 3: The Supreme Court (SC) on Sunday issued an interim order against the government´s decision to implement Proportional Advertising Directive, 2069.



After conducting hearing on a writ petition filed by various advertizing agencies, a single bench of Justice Girish Chandra Lal also ordered the defendants to be present before the court for discussion on whether Proportional Advertising Directive, 2069 should be scrapped as demanded by the petitioners.[break]



Advertising Association of Nepal (AAN) and various advertising agencies associated with it on February 22 had filed a writ petition at the apex court demanding that the Proportional Advertising Directive, 2069 should be scrapped.



The petitioners have claimed that the Proportional Advertising Directive, 2069 is against the Interim Constitution and Public Procurement Act, 2063. They have also maintained that the government did not consult them before taking decision to implement the directive.



The Prime Minister´s Office, Ministry of Information and Communications and the Department of Information have been made defendants in the petition.



A cabinet meeting on January 31 had approved Proportional Advertising Directive for proportional distribution of government advertisements to all the media houses and had decided to implement it from March 14.
