SC show cause to Prez Secretariat over army chief row

KATHMANDU, May 5: The Supreme Court on Tuesday ordered the Secretariat of the President to furnish a written reply within 10 days in regard to the president´s order to army chief Rookmangud Katawal to continue in the office even after his dismissal by the Maoist-led government. [break]



Replying to a writ petition against President Dr Ram Baran Yadav´s move staying the sacking of Katawal, Justice Bala Ram KC also ordered the Office of the Prime Minister and Council of Ministers, Army Headquarters and Katawal to furnish reply regarding the president´s move.



The court, however, refused to issue an interim order as sought by the plaintiffs, saying that different Articles of the Interim Constitution are required to be interpreted during the final hearing before reaching a conclusion in the petition.



President Yadav blocked the government decision removing Katawal and appointing Major General Kul Bahadur Khadka as the acting head of the Nepal Army.



Justice KC issued the show cause notice after a hearing on Tuesday at the apex court. Lawyers pleading on behalf of the plaintiffs argued that the court should intervene in the president´s move over the army chief row. They also warned that if the president´s move is not corrected, the country will plunge into a deep political crisis.



The court further said that it would hear the case with priority once it gets replies from all the defendants, as the issue in the writ petition needs to be finalized as early as possible.
