CPN-UML Chief Whip Bhim Prasad Archarya argued that any proposal that has been tabled during one session of the House does not continue to the next one.[break]
“Whether the proposal becomes successful in garnering House majority or not, it becomes invalid after the prorogation of the session,” Acharya said speaking at the Reporter´s Club in Kathmandu.
He said a new proposal to elect a new prime minister must be tabled after new House session begins.
Acharya also claimed that no proposal till date has been transferred to another session in Nepal´s parliamentary history.
“It has been the practice so far. We must abide by this practice as the parliamentary regulations are silent,” he further said.
However, NC leader and Energy Minister Dr Prakash Sharan Mahat, Tarai Madhes Democratic Party General Secretary Jitendra Sonal, Nepal Sadbhawana Party (Anandidevi) Chairman Sarita Giri and Sadbhawana Party Vice Chairman Laxman Lal Karna argued that the candidacy will remain valid and continues to the next session of the House.
Karna said the proposal to elect a new prime minister was not ordinary one. Instead, it has been tabled as per Article 38 of the Interim Constitution.
“Since the proposal is a constitutional one, there is no way that Paudel´s candidacy becomes invalid,” he said. Moreover, Karna said the proposal is similar to a bill and will automatically be carried forward to the next session.
Likewise, advocates Sher Bahadur KC and Sindhu Nath Pyakurel also said Paudel´s candidacy will remain valid.
KC said, “As per the provision of Clause 20 of the Parliamentary Working Procedure, any proposal will remain intact until it gets decided. In light of the provision, Paudel´s candidacy also remains intact.”
KC and Karna also demanded that Paudel should be elected unopposed as new prime minister as per the ruling of the Supreme Court.
