A two-day meeting of the national executive council, the supreme body of NBA, which concluded in Baglung on Saturday, endorsed the proposal that demands immediate resignation of Regmi as the head of judiciary. The meeting has issued a 19-point declaration. [break]
Addressing a press meet NBA President Hari Krishna Karki said, “Regmi has no alternative other than to resign as CJ. We have decided not to backtrack from our earlier stance on the issue.” Karki maintained that they will stick to their stance as Regmi assumed the post of the head of the executive by violating the universally accepted principle of separation of powers.
NBA has said that Regmi"s continuation as CJ would be an attack on the very basis of the existing constitution. It has also urged the government to announce date for the upcoming Constituent Assembly (CA) election.
“We ask the government to announce poll date at the earliest after creating environment conducive to election,” added Karki.
NBA has also demanded that the vacant posts of judges at the Supreme Court (SC), appellate courts and district courts be filled as absence of has judges in courts have been affecting justice delivery.
NBA has also criticized appointment of ad hoc justices at SC. “Ad hoc justices should be appointed only if there is such a necessity,” NBA General Secretary Sunil Kumar Pokhrel told media persons, adding, “We object to the appointments made against the spirit of an independent judiciary.”
NBA has also demanded formation of truth and reconciliation commission in line with the Interim Constitution and the Comprehensive Peace Accord, 2006.
Similarly, NBA has urged the apex court to make necessary arrangements for easy access of media persons to SC related information. It has also suggested the SC to exercise restraint while dealing with contempt cases, which are filed on the basis of some news, against media organizations.
About 500 law practitioners across the country had taken part in the two-day gathering of NBA"s national executive council.
