NBA objects to JC secretary's letter to Parajuli

KATHMANDU, March 17: Nepal Bar Association (NBA) has expressed its deep concerns over the letter issued on Wednesday by Judicial Council Secretary Nripa Dhwaj Niraula to inform Gopal Prasad Parajuli that he has been relieved of the post of chief justice on age ground. 


Issuing a statement on Friday, the NBA said that the move by JC Secretary to issue a letter directly to the chief justice was inappropriate and done without following the due process and that such practice may set a bad precedent for the future.

In the statement, the NBA said it has concluded that JC Secretary Niraula issued the letter without taking into consideration his authority and duties prescribed by the Judicial Council Act 2073, and also decisions made by JC on different occasions. 


On Wednesday, Secretary Niraula had unilaterally decided to inform Chief Justice Parajuli and other authorities concerned that the latter had reached his retirement age seven months ago as per his academic credentials and was relieved of his post with immediate effect.


The NBA also stated that such practice will set a bad precedent, tarnish the image of the judiciary and also affect the judicial process. “NBA urges all the stakeholders to restrain from any move which may affect the credibility of judiciary,” the statement read.
