NBA decides to recall Judicial Council member Shrestha

KATHMANDU, Jan 6: A meeting of Nepal Bar Association (NBA) has concluded with the decision to recall Ram Prasad Shrestha, a member of the Judicial Council, representing the NBA. This decision was made during the NBA meeting held on Friday evening.

Anjita Khanal, the general secretary of NBA, confirmed that the decision to recall Shrestha had been made, stating, “We haven't made the decision public yet. However, due to his actions being deemed unfit for the NBA, it was decided to recall him.”

Shrestha, appointed by the President on the recommendation of the NBA, served as a member of the Judicial Council since 2077 BS. The decision to recall him was prompted by his unilateral decisions that did not align with the NBA’s consensus and were considered detrimental to legal professionals, according to the NBA.

Earlier, the NBA had invited Shrestha, appointed based on the NBA's recommendation, for a discussion on Thursday. When Shrestha did not attend the meeting, the NBA meeting decided to recall him.

Anjita Khanal, the NBA's general secretary, explained that Shrestha had made a commitment to abide by the NBA's decisions at the time of his appointment. Therefore, the decision to recall him was based on this commitment. Khanal stated, "He had committed during the appointment. He is being recalled because he has gone against his assurance that he would not act against the NBA’s interests and would accept the NBA's decisions.”

The recall of Judicial Council members is typically not possible without impeachment. The NBA's decision to recall Shrestha is intended to exert moral pressure on him.
