A single bench of Justice Tarka Raj Bhatta has summoned the defendants and writ petitioner to in the court on Thursday for the discussion on whether the SC should issue an interim order as demanded by the petitioner. [break]
Advocate Bishwa Prakash Bhandari, who is also chairman of Rastriya Manav Adhikar Sarokar Kendra, moved the apex court on September 19, urging the court to scrap the provision.
He has argued that sub clause (e) of clause 19 of the ordinance related to CA election is against article 65 of the Interim Constitution.
The writ petitioner has claimed that the provision was introduced with an ill-intention against a particular person and a political party as the peace process is yet to reach its logical conclusion.
According to Article 65 of the Interim Constitution, in order for a person to become a member of the CA one must be a citizen of Nepal, have attained at least twenty five years of age, and must not be convicted of a criminal offense involving moral turpitude, not being disqualified by any law and holding any office of profit.
The Office of the President, Chairman of the Interim Election Council Khil Raj Regmi and his office, the Election Commission and the Ministry of Law and Justice have been named as defendants in the writ.
