Compensation mandatory while acquiring private land: SC

KATHMANDU, Sept 26: The Supreme Court (SC) on Wednesday issued a verdict making compensation mandatory on the private land when the government acquires it for public use.

KATHMANDU, Sept 26: The Supreme Court (SC) on Wednesday issued a verdict making compensation mandatory on the private land when the government acquires it for public use.


In the ruling, the SC has reversed the government’s claim that it is not necessary to provide compensation to the land owner when it is acquired for public use since the owner is also benifited.

“The SC takes the government’s claim as a blatant violation of the citizen’s constitutional rights and that it will not remain as a mute spectator on it,” reads the ruling.


Even though the case was heard on August 1, it was made public only today.


In the writ petition, Ministry for Urban Development, Kathmandu Metropolitan City, ward office of Kathmandu Metropolitan-4, Baluwatar and Kathmandu Valley Development Authority have been mentioned as decedents.
