KATHMANDU, Dec 13: The Commission for the Investigation of Abuse of Authority (CIAA) has filed an appeal in the Supreme Court (SC) challenging the decision of the special court in a corruption case against Khadaicha Police Station in-charge Assistant Sub-Inspector (ASI) Gajendra Singh Bhandari.
CIAA filed an appeal in the SC on Friday, expressing dissatisfaction over the decision of the Special Court that acquitted Bhattarai.
Corruption control is a challenge: PM
CIAA had filed a case in the Special Court, demanding a fine and imprisonment as per the section 3 of the Prevention of Corruption Act 2059 BS, accusing Bhattarai of accepting a bribe of Rs 8,000. However, the special court acquitted Bhandari on 25 April, 2024.
The special court had acquitted ASI Bhandari on the ground that there was no clear evidence of accepting bribes. The court decided that the complainant was not able to submit direct evidence to substantiate the allegation and the statement of the plaintiff's witness that the defendant did not appear to have taken the money from the complainant.
CIAA has claimed that there is sufficient direct and circumstantial evidence against the defendant Bhandari, and that the decision of the special court is flawed. Therefore, the CIAA has filed an appeal in the SC, seeking to annul the special court's decision and to convict Bhandari.
