The sub-committee led by Nepali Congress CA member Pushpa Bhusal concluded that the two nominated as CA members by UCPN (Maoist) cannot retain their CA membership as they had defected to form their own Communist Party of Nepal (Maoist).
“Both have gained their status as CA members from the UCPN (Maoist) [then known as CPN (Maoist)] and now they are involved in a separate party. Based on this fact, we have recommended annulment of their CA membership,” said Bhusal, after submitting the report to CA Chair Subas Nembang. The CA Business Advisory Committee will have to take a formal decision in this regard.
As per Clause 139 (C) of the Constituent Assembly Regulations, if a member forms or joins another party, he or she will lose the membership.
Matrika Yadav, however, claims he has taken charge of the CPN (Maoist), which had united with the CPN (Unity Center Masal) last year and become UCPN (Maoist).
On September 14, the CA Business Advisory Committee had formed the sub-committee after receiving an application from the UCPN (Maoist) seeking the annulment. The Maoist party had filed the application on August 3.
Yadav had declared last February that he was no longer with the UCPN (Maoist) after the party united with the CPN (Unity Center Masal). He is currently the coordinator of the CPN (Maoist).
