"The case has finally been settled at the meeting of the Business Advisory Committee today. We decided to go ahead as per the conclusion of the subcommittee formed to investigate the issue," Nembang told myrepublica.com.
The BAC had formed a sub-committee to study the application filed by the UCPN (Maoist) seeking the annulment of CA membership of the Yadav duo for defecting from the party.
On Oct 6, the sub-committee headed by Nepali Congress CA member Pushpa Bhusal had submitted a report to the BAC concluding that the Yadav duo could not retain their membership as they defected from the UCPN (Maoist) to form their own Communist Party of Nepal (Maoist).
"Both have gained their status as CA members from the UCPN (Maoist) [then known as CPN (Maoist)] and now they are involved in a separate party. Based on this fact, we have recommended annulment of their CA membership," Bhusal had told journalists after submitting the report to CA Chair Subas Nembang back then.
As per Clause 139 (C) of the Constituent Assembly Regulations, if a CA member forms or joins another political party, he or she will lose the membership.
However, the Yadav duo claim that they have not defected from the party, but taken charge of the erstwhile CPN (Maoist) that united with CPN-Unity Center (Masal) last year and became UCPN (Maoist). Matrika is the coordinator of the CPN (Maoist) while Jagat is a key party leader.
Both Matrika and Jagat were elected under proportional representation seats of the then CPN (Maoist) [present UCPN (Maoist)].
As per CA regulations, the UCPN (Maoist) will nominate two persons in the seats that have now become vacant.
