Maoist parties forward 8-pt demand to PM

KATHMANDU, April 4: Drawing Prime Minister Sushil Koirala's attention to the Supreme Court (SC) verdict regarding the transitional justice mechanisms, various six Maoists parties have warned that the peace process will be derailed if the apex court does not review its verdict.

UCPN (Maoist), CPN-Maoist, CPN Maoist, CPN (Maoist), Revolutionary Communist Party Nepal (RCPN) and CPN Unified (Ekikrit) submitted a memorandum to the prime minister at his residence in Baluwatar on Friday demanding a review of the SC verdict.UCPN (Maoist) Chief Pushpa Kamal Dahal, CPN-Maoist Chief Mohan Baidya, among other senior leaders of the Maoist parties held a meeting with Koirala and Minister for Law and Justice Narahari Acharya and asked them to withdraw cases filed against the Maoist leaders and cadres.

"The verdict of the SC curtails the jurisdiction of transitional justice mechanisms against the spirit of the Comprehensive Peace Accord (CPA)," said CPN-Maoist Secretary Dev Gurung after the meeting.

The SC verdict of February 26 states that cases that are sub-judice at various courts cannot be transferred to any transitional justice mechanism. As cases against various Maoist senior leaders and cadres are sub-judice in courts, Maoist leaders have been opposing the verdict.

The Maoist parties have forwarded eight-point demand to the prime minister.

Responding to their concerns, PM Koirala assured the parties that their concerns would be addressed. Minister for Law and Justice Narahari Acharya, who also holds the portfolio of the ministry of peace and reconstruction, told the Maoist parties that government is positive toward addressing their concerns, according to Gurung.

"Since it is a part of the peace process, we should sort it out through the consultations. We are even discussing if we should file a review petition at the Supreme Court," Gurung quoted Acharya as saying. The apex court had annulled two controversial provisions of the Truth and Reconciliation Commission (TRC) and Commission on Inquiry into Enforced Disappearances (CIED) Act that give discretionary powers to the transitional justice mechanisms in cases of human rights violations during the conflict.
