The Special Court had issued the summons after the Commission for the Investigation of Abuse of Authority (CIAA) filed a corruption case against the officials nearly a month ago. The court on December 26 had ordered Kansakar and five accused officials to present themselves before the court 15 days.[break]
"We had requested the KDC to hand over the summons letters. The KDC is required to inform us once it dispatches the letters," said Special Court registrar Dhir Bahadur Chand, adding, "But we haven´t received any reply from KDC about whether the summons were served or not."
Kansakar and five NAC officials -- acting assistant general managers Raju Bahadur KC and Ganesh Thakur, Acting Director Gyanendra Purush Dhakal, Director Mayur Sumsher Rana and Acting Deputy Director Keshav Raj Sharma are the other five officials accused of corruption in the Airbus procurement deal.
CIAA in the case has accused the five of embezzling Rs 57.3 million by violating the Public Procurement Act while sending non-refundable money to Airbus. After the CIAA filed the cases against the five officials, they had filed a peititon at the Supreme Court seeking an interim order against the Special Court´s move, but the Supreme Court rejected the petition.
As per the existing law, one has to present himself before court within 15 days from the date of receiving court summons.
The court can allow a grace period of another 15 days if those summoned submit a written application citing their inability to appear before the court on health grounds.
