Addressing a function organized in the capital on Tuesday, Acharya said the CA cannot be revived as it has lost legitimacy. "Democratic norms and values do not allow revival of the dissolved CA," he said.[break]
Acharya said that a revived CA cannot endorse the new constitution as CA is not only supposed to endorse the constitution but also to hold discussions on constitutional provisions before promulgating it.
"Only a freshly elected CA would have legitimacy," he argued. Acharya also maintained that some constitutional provisions have already become defunct following the demise of CA on May 27. "Political parties should now move ahead in accordance with constitutional provisions that are still effective," he added.
Acharya, however, said that new laws may be introduced through ordinances or by allowing the president to use his power to remove constitutional difficulties.
In a separate context, Acharya accused Prime Minister Baburam Bhattarai of staging a “full fledged coup” by dissolving the CA. "The CA was dissolved so that he would be able to exercise all state powers," he added.
