Law minister discusses recommendations disupte with speaker

KATHMANDU, March 14: Minister for Law and Justice Agni Kharel on Sunday talked to Speaker Onsari Gharti on the controversy over the speaker's sending back of the Judicial Council recommendations for 11 vacant posts of justices at the Supreme Court.

According to a source, Minister Kharel urged the speaker to take initiative for drafting Parliamentary Regulations soon through the drafting committee and settle the issue. "In reply, the speaker stressed that every side should move forward in a balanced way and the latest events should not disrupt the relations and balance between judiciary and legislature," informed the source.


The Parliament Secretariat last week had sent back the council's recommendations arguing that the council itself was yet to get full-shape to make such recommendation and the parliament also had yet to pass new parliamentary regulations and form a parliamentary hearings special committee.

Speaker's move has displeased the Judicial Council. However, the council has yet to discuss how to tackle the issue. "The council will meet soon and discuss whether to forward the recommendations again to parliament or not," said a source at the Judicial Council.

Two weeks ago, the Judicial Council had recommended Deepak Kumar Karki, Kedar Chalise, Sharada Prasad Ghimire, Mira Khadka, Hari Krishna Karki, Bishwambhar Prasad Shrestha, Ishwar Khatiwada, Aananda Mohan Bhattarai, Anil Kumar Sinha, Prakash Man Singh Raut and Sapana Pradhan Malla for parliamentary hearings for appointment as justices at the Supreme Court.

Supreme Court accepts writ petitions

Meanwhile, the Supreme Court registered two writ petitions with conflicting claims regarding the recommendations made for justices.

A day after advocate Bijay Singh Sijapati moved the Supreme Court challenging the Judicial Council's recommendations for 11 justices, a writ petition has been filed at the apex court on Friday against the decision of the Parliament Secretariat and Speaker Onsari Gharti to send back the recommendations. After considering both the petitions for a couple of days on whether to register or formally reject them, the court administration finally registered both the petitions.

Meanwhile, advocate Raksharam Harijan and some others on Sunday filed yet another writ petition challenging the council's recommendations arguing that the recommendation made by council ignored the principle of inclusion accepted by the constitution. According to the court administration, the third writ petition is under its consideration whether to register or reject it.
