SC bars Madhesh Chief Minister from making policy decisions

KATHMANDU, Nov 19: The Supreme Court has ordered Chief Minister (CM) of Madhesh Province, Saroj Kumar Yadav, not to make policy-level and strategic decisions till the final hearing on the case he is facing. 

A division bench of justices Nahakul Subedi and Sunil Kumar Pokhrel issued the interim order on Tuesday, asking Chief Minister Yadav to refrain from policy decisions that can have a long-term impact. 

"Serious questions were raised on the values and transparency of parliamentary democracy in the prima facie in relation to the appointment of the Chief Minister. It therefore needs a final hearing. The government, said to be formed on November 9, should not be involved in the policy-level and strategic decisions," the order stated. 

A writ petition was filed by the parliamentary party leader of the Nepali Congress in Madhesh Province Assembly, Krishna Prasad Yadav, against the appointment of Chief Minister Yadav, a member of the CPN UML. The final hearing on the case is slated for November 27.
