A special bench comprising justices Kalyan Shrestha, Prakash Wosti and Bharat Raj Upreti took the decision to call in six lawyers from Nepal Bar Association, four from the Supreme Court Bar Association and two each from Nepal Law Campus and Kathmandu School of Law as amicus curiae.
In its budget for the current fiscal year the government has set out a plan to establish the benches. The plan has been dragged into deep controversy after advocate Madhav Kumar Basnet filed public interest litigation at the apex court to prevent the government from implementing it. He has argued that such a move will undermine judicial independence.
