After her family members did not grant her equal share of the ancestral property, Durgadevi Dahal, 43, on Thursday filed the case against her father Surya Prasad and brothers Ram Prasad, Shiva Kumar and Suman Kumar. [break]
“Getting equal share of property is my right. I made several attempts to make them understand this and provide me the share, but they never took it seriously,” said Durgadevi. “So I was forced to go through the legal process.”
Narayan Prasad Chaulagain, the president of Nepal Bar Association, Taplejung said the case is the first of its kind in the district. “If Durgadevi has demanded equal property rights, the father and brothers should not deny it. She is simply demanding what is her right.”
Similarly, a women´s rights activist Radhika Khadka echoed Chaulagain and said the family members have no choice than to grant what Durgadevi has demanded. “It is sad that she has to fight for what has already been guaranteed by the law,” Khadka said.
“As people are yet to realize that the law has ensured equal property rights for sons and daughters, more such cases might come up in future,” she noted.
