UML against parliament interpreting constitution

KATHMANDU, Aug 20: Senior leaders of the Communist Party of Nepal (Unified Marxist-Leninist) at its parliamentary party meeting on Thursday instructed Constituent Assembly (CA) members of the party to oppose the idea of appointing the Chief Justice (CJ) of the Supreme Court (SC) through parliament. The UML also decided not to accept parliament as the final authority for interpreting the constitution.



Unified CPN (Maoist) CA members on the CA committee for determining the judicial system are pushing the aforementioned ideas for inclusion in the new constitution.



The Maoist CA members on the committee are also lobbying for a system of appointing the CJ from among persons other than incumbent justices of the SC also.



"Our party at the meeting unanimously decided not to accept parliament as the final authority for interpreting the constitution, a system of appointing the CJ through parliament and the idea of appointing the CJ from among persons other than the incumbent SC justices also," CA member from the UML Ram Nath Dhakal told myrepublica.com, describing these as the party´s official policy.



CPN-UML and Nepali Congress CA members are for proposing the Supreme Court as the final authority for interpreting the constitution and for appointment of the CJ by the head of state on the recommendation of the Constitutional Council subject to confirmation by the parliamentary public hearings committee.



Under the existing system, the seniormost among the incumbent justices of the SC is appointed CJ. The NC and CPN-UML are for giving continuity to this system.
