KATHMANDU, Aug 5: Lack of enough evidence has prevented the police from filing a murder case against the three people identified as suspect in the alleged murder of an American citizen in 2010.

A squad of Central Investigation Bureau (CIB) had nabbed the three suspects Friday in connection with the possible murder of Aubrey Caroline Sacco, a US national who had gone missing from the Langtang area of Rasuwa district three years ago. [break]

According to a CIB official, preliminary investigation did not find any involvement of the three accused in the possible murder as claimed in recent media reports.

In absence of any evidence, the CIB on Sunday filed a case against the three charging them with misbehaving and using abusive language against the police, under the Public Offence Act. The District Administration Office Kathmandu has remanded them to police custody for seven days.

“We have not arrived at a conclusion yet and the investigation is still under way,” DIG Prakash Aryal, chief of CIB said.

CIB, in coordination with the Nepal Police, had arrested Jagat Tamang, of Bhorle VDC-1, and Pemba Tamang, of Saramthali VDC-9 in Rasuwa district.

But when interrogated by the police, Jagat and Pemba pointed out at other people for their role in Aubrey´s murder.

DIG Nawaraj Silwal, who is also the police spokesperson, said though the police is still questioning them by taking into custody, they seemed not to be connected with the ´murder´ case.

According to the police, Lakpa Lopchan of the same area was also arrested based on the statement of the two.

Reportedly, Jagat and Pemba had claimed that Aubrey was murdered shortly after she went missing while on a trek to Langtang. As she did not return on the expected time from Langtang, her parents had started searching for her.

Reportedly her dead body, passport and other documents were thrown into the Langtang River and the camera that was assumed to be looted from her, has not been retrieved so far, according to the police. Locals were quoted as saying that Jagat and Pemba had told the police that Lakpa masterminded the kidnapping and murder of Aubrey.

On April 2013, Aubrey´s parents had announced a prize of $25,000 to anyone who could provide information on their daughter´s whereabouts after their efforts to trace their missing daughter went in vain.
