A single bench of Justice Ramkumar Prasad Saha issued the order to this effect in the name of the Office of the President, Office of the Council of Ministers, the Constitutional Council, CIAA and CIAA Chief Karki, following preliminary hearing on a writ petition filed by advocate Om Prakash Aryal on May 12.[break]
The bench also ordered that the writ be presented before a joint bench on May 26 to decide whether or not a stay order needs to be issued, after the defendants put forth their views.
Advocate Aryal had in the writ petition sought that the Supreme Court issue interim order halting activities like appointing, administering of oath of office and assigning responsibilities to Karki until his petition was finalized.
Karki, who was implicated by the CIAA on abuse of authority while holding public office, was recommended by the Constitutional Council to head the anti-graft body and the President had subsequently appointed him to the high office.
