SC stays ban on network marketing business

KATHMANDU, May 30: The Supreme Court has stayed the government decision banning networking business saying that such a decision causes irreparable loss to the business and is not appropriate from the view of privilege and balance.



Issuing a notice on May 24, the government had banned all kinds of networking businesses by issuing a notice and annulled Directives on Network Marketing of Commodities with immediate effect. The Department of Commerce had issued the directives allowing network marketing on commodities two months ago. [break]



Taking up a writ petition against the decision, a division bench of justices Khil Raj Regmi and Tap Bahadur Magar ordered the government not to implement the notice till the court gives a final decision on the issue.



Following the government decision and the notice, network business firms had moved the court with a writ petition, asking the court to nullify the government ban on their business and the notice. The government had taken the decision amidst government actions on Unity Life International, a business firm that cheated Nepalis for years.



The court said that the Department of Commerce first permitted network business and then imposed the ban. Passing the stay order, the court further said that the notice does not clearly state as to why the ban was imposed. In addition, the department issued the notice before an investigation, which is underway, reaches a conclusion, the court said.
