A three-member bench comprising justices Kalyan Shrestha, Gyanendra Bahadur Karki and Baidhyanath Upadhyay overruled the nine month old verdict of the division bench to sack Gupta from his post.
Nepal Sadbhawana Party (Anandi Devi) had filed a petition at the SC demanding Gupta´s dismissal from the post. Gupta was appointed as CA member by the cabinet without consent of the party in 2008.
