A full bench of Officiating Chief Justice Damodar Prasad Sharma and Sushila Karki on Monday refused to continue interim order stating that the issues raised by the writ petitioners would be addressed when the court issues final verdict. [break]
A single bench of Justice Girish Chandra Lal on March 3 had issued an interim order against the government´s decision to implement the Proportional Advertising Directive, 2069.
The apex court had also ordered the defendants to be present before the court for discussion on whether the directive should be scrapped as demanded by the petitioners.
Advertising Association of Nepal (AAN) and various advertising agencies associated with it had filed a writ petition at the apex court on February 22 demanding that the Proportional Advertising Directive, 2069 be scrapped.
The petitioners had claimed that the directive is against the Interim Constitution and the Public Procurement Act, 2063. They had also maintained that the government did not consult them before taking decision to implement the directive.
The prime minister´s office, the Ministry of Information and Communications and the Department of Information were made defendants in the petition.
A cabinet meeting on January 31 had approved the Proportional Advertising Directive,2069 for proportional distribution of government advertisements to all the media houses and had decided to implement it from March 14.
