KATHMANDU, Jan 5: The Supreme Court (SC) on Thursday directed the government authorities to manage the parking problem across the country.
 
Acting on a public interest litigation filed by advocate Tulsi Simkhada, the apex court issued a mandamus order to the Office of the Prime Minister and Council of Ministers and the Ministry of Transportation Management to do the needful to resolve the parking problem.
 
A division bench of justices Tej Bahadur KC and Purushottam Bhandari issued the order following a final hearing on the petition on Thursday. The petitioner had claimed that the authorities have not been using the various taxes collected from vehicle owners to resolve the parking problem. The petitioner has claimed that there are several laws that require the authorities concerned to resolve transport and parking problems. 

The petitioner has cited Section 121 of the Vehicle and Transportation Management Act, 1992, which states that the government authorities should manage the parking lot and bus parks in the cities and villages, and argued that Section 6 of Consumer Protection Act, 1998 ensures consumers' right to parking space.

In his petition, Simkhada also cited Section 8(C) of Local Governance Operation Act which has mandated Metropolitan City, Sub-Metropolitan City and Municipalities to manage parking lots in their respective areas with enough spaces because this problem has been increasing across the country.
