A special bench of Justices Kalyan Kumar Shrestha, Girish Chandra Lal and Sushila Karki on Thursday said the hearing on two writ petitions filed by Advocates Bharat Mani Jangam and Om Prakash Aryal separately will be conducted on March 14 stating that both petitions have raised the same questions. Earlier, Vice-president of Nepal Bar Association (NBA) Tikaram Bhattarai on the behalf of the writ petitioner Jangam had urged the special bench to conduct a hearing on the petition together the petition filed by Aryal.
A single bench of Justice Sushila Karki on February 24 had decided to forward the case to a special bench stating that it was necessary to interpret many laws before issuing a final verdict on the issue.
Advocate Jangam on February 17 had filed a writ petition at the apex court arguing that a government-led by the sitting chief justice would encroach on the independence of the judiciary while Aryal on February 26 had filed the writ petition arguing that the formation of CJ-led government would be a hindrance to the people´s right to unbiased legal and constitutional remedy as stated in Article 32 of the interim constitution.
After the hearing on the writ petition filed by Aryal, a single bench of Justice Lal on Tuesday had forwarded the writ petition to a special bench stating that the writ petition has raised a complex constitutional question and that the next hearing on the petition would be held on March 14.
