A division bench of Justices Deepak Raj Joshi and Cholendra SJB Rana altered the verdict of Special Court and acquitted Sharma in the case accusing Sharma of amassing disproportionate amount of wealth.

Special Court on September 2, 2010 had slapped a one-year jail sentence and a fine of Rs 20.2 million on Sharma after finding him guilty of corruption. Stating the total value of property registered in the name of Sharma, his wife Rupa Dhungel and daughter Priti Dhungel exceeded Rs 31.6 million, the Special Court had stated that Sharma could not show any legal source to the property worth Rs 20 million.

Following the verdict, Sharma moved the Supreme Court challenging it. The Commission for Investigation of Abuse of Authority (CIAA) had filed a corruption case against Sharma in 2003.
